The Thirteenth Amendment and John Bingham

At Concurring Opinions, Gerald Magliocca takes note of the U.S. v. Cannon decision (see earlier post for background). He notes that “One question worth asking is if that authority (and the Court’s 1968 decision in Jones v. Alfred H. Mayer Co) will eventually be narrowed to make them consistent with City of BoerneShelby County, and other recent cases on Congress’s enforcement power under the Reconstruction Amendments.” Magliocca also offers some historical background on the narrow view of the Thirteenth Amendment taken by John Bingham, one of the most prominent members of the Reconstruction Congress.
