Sexual assault, federalism, and administrative law

At Prawfsblawg, Rick Hills has two excellent posts up on federalism and the new Obama administration sexual assault guidance. The first addresses federalism concerns, and the second addresses whether OCR should have used notice and comment rulemaking to promulgate this document. Although I normally counsel against reading the comments sections of blogs, the thread following the notice-and-comment rulemaking is a refreshing exception to the rule.
